1. Introduction Welcome to Dream Dealz LLC. These terms and conditions (the “Agreement”) govern your use of our online liquidation auction website (dreamdealzky.com). By using dreamdealzky.com, you agree to be bound by these terms and conditions. If you do not agree to these terms and conditions, you may not use the dreamdealzky.com.
2. Acceptance of Agreement Your use of dreamdealzky.com constitutes your acceptance of this Agreement. Dream Dealz LLC reserves the right to update or modify this Agreement at any time without prior notice. Your continued use of dreamdealzky.com following any such changes constitutes your acceptance of the revised Agreement.
3. Registration In order to access certain features of dreamdealzky.com, you may be required to register with Dream Dealz LLC. You must provide accurate and complete information when registering, and you agree to keep your registration information up-to-date. You are responsible for maintaining the confidentiality of your password and account, and you agree to notify Dream Dealz LLC immediately if you become aware of any unauthorized use of your account.
4. Auctions Dream Dealz LLC offers consumer products for sale through online liquidation auctions. All auctions will incur a buyers premium that will be subject to change at the discretion of Dream Dealz LLC. During the time of any live auction Dream Dealz LLC has the right to make adjustments or terminate any auction without cause if seen fit. The highest bidder at the close of an auction will be deemed the winning bidder, subject to the reserve price and any other terms and conditions set forth by Dream Dealz LLC.
5. Payment All winning bidders must pay the full purchase price plus any applicable taxes and shipping fees, payment is due immediately following the winning bid of such auction. Dream Dealz LLC accepts payment by credit card or other payment methods as specified on the Site. Failure to make timely payment may result in cancellation of the sale and forfeiture of any deposit or other payment made by the winning bidder.
6. Pickup-Dream Dealz LLC . 2501 Millers Ln Unit 10.Won auctions are to be scheduled for pickup immediately upon payment being received. If paid auctions aren’t picked up within the scheduled time slot Dream Dealz LLC has the right to relist any winning auction within 48 hours of failed pick up with no refund offered.
7. Returns All sales are final and no returns will be accepted, except as required by law. Dream Dealz LLC will not be responsible for any damages or defects in the products sold through the Site.
8. Disclaimer of Warranties Dream Dealz LLC and all products sold through the Site are provided “as is” and without warranties of any kind, express or implied. Dream Dealz LLC disclaims all warranties, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of Liability Dream Dealz LLC will not be liable for any damages of any kind arising out of or in connection with your use of the Site or products sold through the Site. Individuals coming to pick up winning auctions of the site will be responsible for any damages of their own personal property including but not limited to (vehicles, winning auctions being handled during pickup, tools used for pickup of auctions, bodily damage or physical injuries acquired on property upon pickup or any personal belongings that come in contact with the Dream Dealz LLC pickup facility) including, but not limited to, direct, indirect, incidental, punitive, and consequential damages.
10. Indemnification You agree to indemnify and hold Dream Dealz LLC and its affiliates, officers, directors, employees, and agents harmless from any claim or demand, including reasonable attorneys’ fees, arising out of or in connection with your use of the Site or products sold through the Site.
11. Governing Law and Jurisdiction This Agreement will be governed by and construed in accordance with the laws of the State of Kentucky, without giving effect to any principle
